- Firstly, one needs to establish whether your husband pronounced the divorce correctly. A husband issues a divorce by uttering the words of divorce. He thus says to his wife, “I divorce you” or “You are divorced.” He may also divorce his wife with an implied utterance such as, “Return to your family” or “Enter into ‘iddah (the waiting period after divorce).” An implied divorce, however, must be accompanied by the intention of divorce.
- Once it is established that a correct divorce pronouncement has occurred, the divorce is considered valid regardless of whether any papers are signed afterwards. It’s important to note that if the couple wishes to reconcile and return to each other, they may do so, provided that the husband has not issued three divorces.
- During the ‘iddah or waiting period, the husband is required to provide his wife with the living space they previously shared. If the home’s layout allows for separate accommodations, ensuring that he has a distinct room along with its own kitchen and bathroom to avoid interaction with his divorced wife, this arrangement would be permissible. Alternatively, if the living space cannot be divided as required, the husband should arrange for alternative lodging for himself.

إذا وجبت السكنى فإنما (تسكن) بضم أوله بخطه أي المعتدة حتما (في مسكن) مستحق للزوج لائق بها (كانت فيه عند الفرقة) بموت أو غيره للآية وحديث فريعة السابقين .وليس للزوج وغيره إخراجها ولا لها خروج .منه وإن رضي به الزوج إلا لعذر كما سيأتي لأن في العدة حق الله تعالى والحق الذي لله تعالى لا يسقط بالتراضي بالضاد وقد قال تعالى ﴿لا تخرجوهن من بيوتهن ولا يخرجن﴾

(و) يحرم على المطلق أيضا (مساكنتها) ومداخلتها ويعصي بذلك لقوله نعلى: (وَلَا تُضَارُّوهُنَّ لِتُضَيِّقُوا عَلَيْهِنَّ) أراد بذلك المسكن ولأنه يؤدي إلى الخلوة به، وهي محرمة وسواء كانت بائنا أو رجعية (النجم ج١٧٦/٨) (إلا أن يكون كل منهما في بيت) أي غرفة (بمرافقه) من المطبخ والمصعد إلى السطح وممر وأغلق باب بينهما أو سد وان لم يوجد محرم لانتفاء المحذور لكنه يكره لأنه لا يؤمن معه النظر وكذا يجوز مساكنتها في دار واسعة مع مميز بصير محرم لها ذكرا كان أو أنثى أو مع مميز بصير محرم له بشرط أن يكون أنثى أو حليلة ين زوجة أو أمة وإن لم تنفرد بمرافق ومستراح وممر وغير ذلك (شرح المنهج ج ٤ /٤٦٦ – ٤٦٧ بالمعنى)
