Non-financial contributions by either spouse, unless stipulated beforehand, is considered altruistic. Spouses can, therefore, not claim to be paid out for altruistic contributions. If, however, by way of example, the wife reaches an agreement with her husband that he will be paying her a certain amount of money for child-rearing or housekeeping, and he then fails to do so during the course of the marriage; the wife may claim those funds and it should be considered when deciding a redistribution order. That the wife can request payment for these types of services is taken from the fiqhi discussion that permits her to request a suitable payment for the breastfeeding of their child. Please note, if the concern is that the wife should be compensated somehow at the time of separation, the Shari’ah has legislated an obligatory amenity payment (mut’ah) that the husband pays the wife at the time of separation. In the instance that the spouses cannot come to an agreement regarding the amount of this payment, a judge may use his discretion in determining an amount based on the financial state of both husband and wife.
